So I tripped and fell yesterday. Now usually no big deal, but since I'm working from home, I reached out to HR to find out what is the Covid-19 protocol for that. She didn't think Workman's Comp would cover anything since it took place in my home and not the office. I was welcome to go to the ER if I felt it was warranted, but doubted it would be covered.

Don't get me wrong, I've more than met my medical deductible for the year so it's not the expense that concerned me, it's the point of fact that had it happened at corporate, THEY would have insisted on an incident report, probably a drug test, and surely shipped my ass off to Urgent Care or the
ER. Since I'm working from home, it's my problem, DEAL WITH IT!

Today is much, much better than I feared. Pretty sure left wrist is either sprained or strained, but I found an old brace and am making it work. Right hand is bruised, but doing okay with the typing (mostly one handed) for work. Both knees are bruised and the left one while still swollen, isn't a balloon like it was yesterday. Probably have damaged something, but not enough to warrant a trip to the ER/Urgent Care.

Hell, I even managed to sleep a little bit despite the additional aches & pains, so am counting this as a good morning. Y'all have a great Tuesday!

Sounds like a rough day, but I am glad you're feeling somewhat better today. I hope you didn't injure worse than strains and bruises. Try to take it easy today! 😊💜

I’d visit the doc and report it as workman’s comp just to have a paper trail just in case you suffer from injury later on etc. Feel better, speedy recovery.

Sounds like you took a big tumble. Sorry for your injuries but glad you're ok. In my experience workmans comp isn't worth it unless injury is very serious. They'll force you to see their dr, he won't diagnose much if anything since dr working to protect business. Heck, after a fall on the job they wouldn't even pay to cover time off to see their dr per their procedures. Please take care of yourself and see your own dr if necessary. Feel better soon 🙏💛

Agree with lowkey. Always better to have the paper trail in case it’s needed later. And if your deductible has been met then it’s not that much of a hardship. Hope you feel better soon! Be sure to ice the knee and anything else with swelling (15-20 minutes in and 15-20 minutes off). Also an anti inflammatory like Advil might be helpful. These are things my dr has told us on sprained ankles, broken wrists etc.

So sorry about your fall. Hope you recover soon. These things often linger. Also, I'm sorry I offended you in Debbie's comments when I mentioned the governor wanting people to put on their masks between bites. I should not have given a commentary. I try to be very diligent in wearing a mask and distancing myself from others since I have an 84-year-old husband I need to protect. He just got out of the hospital 5 weeks ago with kidney failure. We have only been out to eat (in outdoor dining only) about 3 or 4 times since February or March. I'm sorry if I seemed to have a lack of respect for the governor. I just didn't know how to take it. Well, it's in the past now, they just closed all our outdoor dining. Hope your injuries heal quickly.

So glad you're doing some better! Lots of new territory to be explored with the new protocols (actually, they're getting OLD to me already). Hope you'll stay on the mend!

I guess this concept of injury in your own home yet you are on the clock will have to be dealt with. I can totally see why this WOULD NOT be a workman’s comp issue at all but it will be interesting to see how it will play out in court because somewhere, sometime someone will feel a need to sue. That’s just how we are, a litigiousness society.. Your employer has no control over how your house is set up, rugs on the floor, uneven surfaces, too many odds and ends blocking pathways, etc.

It sounds like a pretty bad fall. I hope you get the care you need if it doesn't seem to be getting better on its own.

I'm pretty sure your HR person is incorrect. If you are on the job it doesn't matter where you are. If you had been out somewhere as part of your work and fallen, you would be covered and this is no different. See a doctor and claim worker's comp to protect yourself in case there are complications.

Well Jeannie, as an HR Manager and Director for more than 10 years and being in the HR profession for over 30 years what they told you is correct. Putting it very bluntly, if you did it at home, it is your problem. It is up to you to maintain your home and handle those issues. That is the law. Can you imagine what would happen if it were not the law? As it is, we get people who hurt themselves outside of the workplace and then try to claim compensation - if they were allowed to claim accidents in the home, more companies would go out of business than with Andrew Cuomo's COVID plan. It would be devastating. Everyone is not as honest as you are. In any event I am glad to hear you are doing good today.

@ shirfleur 1, you are not totally incorrect. There are cases in which you can be away from the work location and if injured as part of your job, a compensation claim may still be filed. In some cases you can file a claim and then it is the insurance companies responsibility to follow up and file against the entity that caused or put you in a situation in which you received the injury. I know the law seems complicated to someone not in the that field (HR or Insurance) but I just wanted to let you know what you said is not totally incorrect. The other factor, in addition to what I wrote and you wrote is the State or country in which you are employed. My response was based on general employment laws in the majority of the US. (I probably should have included that in a disclaimer)

I’m also in the HR field and get what you’re saying Jim but I’ve fought my work comp for years (granted I’ve only been in the field for 5 years) but as a director at my last company I was told bluntly by our Work Comp benefits team that would she be in that situation had it not been for her job? And if so the company can be liable. I have worked with remote employees now for five years and let me tell you it’s a whole different ball of wax. In Oregon I have fought many times about my remote employees being on a break between shifts, then falling and hurting themselves and because they were on the clock we were liable for damages under our policies.

Also Jen I’m so sorry to hear about this! I agree with what was suggested always document everything. I hope you feel better soon! Being in HR it rly saddens me that some companies give the profession a bad name—that they may give misinformation or tell half truths because they’re trying to save their company money. Jim is right thought the law is the law and that’s what should be upheld. Take care of yourself and if you feel it necessary speak to a work comp lawyer
